        Introduced  by  Sen. JACKSON -- read twice and ordered printed, and when
          printed to be committed to the Committee on Rules
 
        AN ACT to amend the vehicle and traffic law, in relation to fees charged
          to certain motorists
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The  vehicle  and  traffic law is amended by adding a new
     2  section 516-c to read as follows:
     3    § 516-c. Non-cooperation fees.  The  New  York  city  commissioner  of
     4  transportation  is  authorized  to  impose a fee of fifty dollars on any
     5  vehicle entering the city of New York which  displays  a  license  plate
     6  from  a  state  which  does not provide or exchange reasonably necessary
     7  information related to drivers licensed by such state for the purpose of
     8  permitting the imposition of fines or penalties for traffic infractions,
     9  including liability imposed through the use of a traffic control  signal
    10  monitoring  system,  a  speed  control  device or other photo-monitoring
    11  system authorized for use  in  such  city  to  enforce  certain  traffic
    12  infractions.
    13    2.  The  New  York  city  department of transportation shall determine
    14  which states' vehicles are subject to the fee authorized by this section
    15  and may construct, operate and maintain facilities and equipment for the
    16  identification of such vehicles and the collection of such fee.
    17    3. a. The fee may be paid by the operator of the vehicle in  cash,  or
    18  by debit or credit card. If the operator of the vehicle is unable to pay
    19  the  fee at the point of collection, the operator shall provide informa-
    20  tion to the department of transportation staff including the  operator's
    21  name,  address and telephone number and the vehicle license plate number
    22  so that the department may bill the operator of the vehicle for the fee.
    23    b. The commissioner of the department of transportation of the city of
    24  New York shall, in conjunction with the commissioner of finance and  any
    25  other  city  agency,  enter into at least one agreement with a financing
    26  agency or card issuer to provide for the acceptance by the city  of  New
    27  York of credit cards as an alternate means of payment of the fee.

     1    4.  All  revenues collected from fees charged under this section shall
     2  be deposited in the general fund of the city of New York.
     3    5.  The  commissioner  of transportation of the city of New York shall
     4  promulgate rules and regulations to effectuate the  provisions  of  this
     5  section.
     6    § 2. This act shall take effect immediately.
