TITLE OF BILL:

PURPOSE OR GENERAL IDEA OF BILL:
Requires warning labels on all containers that contain bisphenol A
 
SUMMARY:
Section 37-0501 of the environmental conservation law, as added by chap-
ter 280 of the laws of 2010, is amended to read as follows: § 37-0501.
Short title. This title shall be known and may be cited as the "bisphe-
nol A-free  
children and babies act". § 2. Section 37-0507 of the envi-
ronmental conservation law, as added by chapter 280 of the laws of 2010,
is amended to read as follows: § 37-0507. Product labeling. 1. The
commissioner may authorize product labeling of products that do not
contain bisphenol A. The label on such products may prominently state
"Bisphenol A Free" or "BPA-Free" to inform consumers that the product
does not contain the chemical bisphenol A. 2. A warning label shall be
affixed to all containers that contain the chemical bisphenol A. Such
warning label shall clearly state that it is harmful to an individual's
health if such container is microwaved or otherwise heated.
 
JUSTIFICATION:
Several studies have shown that exposure to Bisphenol A ("BPA") affects
human physiology controlled by the endocrine and prostate gland, and
brain development in fetuses, infants, and children. The use of plastic
containing BPA can also affect children's health and behavior. Another
study has indicated a possible relation between BPA and an increase in
blood pressure, Type 2 diabetes, and cardiovascular diseases.
BPA began to be used in epoxy resins and in the manufacture of polycar-
bonate plastics in 1950. However, in 1970, the US National Toxicology
Program found that BPA was toxic to reproductive organs. After several
research trials, in 2008, the United States Food and Drug Administration
(USFDA) set a limit on the concentration of BPA, while Canada imposed a
limited ban on the use of BPA and classified it as a toxic substance.
The importance of providing BPA free packaging is paramount in safety of
all consumers.

EFFECTIVE DATE:
This act shall take effect on the sixtieth day after it shall have
become a law. Effective immediately, the addition, amendment, and/or
repeal of any rule or regulation necessary for the implementation of
this act on its effective date are authorized to be made and completed
on or before such effective date.

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 37-0501 of the environmental conservation law, as
