NEW YORK STATE ASSEMBLY MEMORANDUM IN SUPPORT OF LEGISLATION submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A4532
SPONSOR: Ra

TITLE OF BILL:
An act to amend the legislative law, in relation to creation of the
non-partisan office of policy research and fiscal analysis

PURPOSE:
To authorize the creation of a non-partisan Office of Policy Research
and Fiscal Analysis that will be tasked with reviewing and conducting
cost benefit analysis of legislation, state programs and the state budg-
et upon request.

SUMMARY OF PROVISIONS:
Section 1 amends legislative law to add a new article 4-B to create a
new non-partisan office of policy research and fiscal analysis. The
office would be authorized to provide expert support to legislative
members. The new office will be run by a director who shall be appointed
by a joint resolution requiring the vote of two-thirds of the members of
both the Assembly and the Senate. The director will be chosen for the
Assembly and Senate to vote on by the temporary president of the Senate
and speaker of the Assembly in consultation with the senate minority
leader and assembly minority leader. The director will serve for a term
of seven years and will appoint their deputy director.
Upon request, the office will provide non-partisan and confidential
information on the impact of current and proposed budgetary and legisla-
tive policy to any member of the Assembly or Senate and would provide
comprehensive assessments on certain aspects of the State budget. On
March 1 of each year, the office will also produce a report which will
include evaluations and assessments of the executive budget and quarter-
ly updates to the financial plan released by the division of budget. The
office will also provide expert testimony for Senate and Assembly hear-
ings and hold seminars and workshops on policy issues. Further, the
office will provide a subsequent report on December 1 of each year which
will include information about requests received, services provided, and
a description of all non-confidential products produced by the office.
Section 2 amends section 30 of legislative law, as amended by chapter
766 of the laws of 2005, in order to provide funding for said office of
policy research and analysis.

JUSTIFICATION:
The creation of a non-partisan and impartial office dedicated to policy
research and fiscal analysis is vital for equipping legislators with
accurate, expert information. This office will provide unbiased insights
into the impacts of proposed policies and budgets. Such non-partisan
models have proven effective at federal, state, and local levels, offer-
ing a clear path to better governance.
This independent office will collaborate closely with existing legisla-
tive finance offices and will ensure legislators have access to compre-
hensive and reliable information. To support informed decision making,
the office will issue two annual reports, on March 1st and December 1',
outlining the fiscal and policy implications of the budget and proposed
measures. The process of selecting the director with involvement from
members of both parties, combined with the non-partisan nature of the
office and the pivotal information it provides in its reports, will act
as a tool to help curb partisan conflicts in policy making.
