NEW YORK STATE ASSEMBLY MEMORANDUM IN SUPPORT OF LEGISLATION submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A9520
SPONSOR: Joyner

TITLE OF BILL:
An act to amend the public health law, in relation to the establishment
of obstetric hemorrhage protocols

PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this bill is to adjust reporting requirements for hospi-
tals in relation to obstetric hemorrhage protocols that they are
required to develop pursuant to Chapter 662 of the Laws of 2019.

SUMMARY OF SPECIFIC PROVISIONS:
Section 1 would eliminate the requirement that hospitals submit their
obstetric to the Department of Health (DOH) and would instead require
hospitals to maintain and furnish their obstetric hemorrhage protocols
to immediately, upon request.
Section 2 establishes the effective date.

JUSTIFICATION:
Chapter 662 of the Laws of 2019 required hospitals to develop, imple-
ment, and periodically update obstetric hemorrhage protocols. This
amendment will have hospitals maintain these protocols for DOH for
review, but eliminates the automatic requirement that the information be
shared with DOH whenever a protocol is updated. This will reduce admin-
istrative burdens for hospitals and DOH in maintaining these protocols.

PRIOR LEGISLATIVE HISTORY:
New Legislation.

FISCAL IMPLICATIONS:
None to the State.

EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2019, amending the public health law relating to
the establishment of obstetric hemorrhage protocols, as proposed in
legislative bills numbers S. 4498-A and A. 6962-A, takes effect.
