TITLE OF BILL:
An act to amend the state law, in relation to establishing congressional
districts; and to repeal article 7 of such law relating thereto
 
PURPOSE:
The purpose of this bill is to establish 26 Congressional districts in
and for the State of New York.
 
SUMMARY OF PROVISIONS:
This bill would provide metes & bounds descriptions of 26 Congressional
districts.
 
EXISTING LAW:
This bill would amend the State Law to provide for the reapportionment
of the New York State Congressional districts.
 
JUSTIFICATION:
This bill establishes new Congressional districts for the State of New
York. It is based on population figures derived from the 2020 Federal
Census. The districts comply with the United States and New York State
Constitutions and the requirements of the Federal Voting Rights Act.

EFFECTIVE DATE:
This act shall take effect immediately.

AN ACT to amend the state law, in relation to establishing congressional
districts; and to repeal article 7 of such law relating thereto
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Article 7 of the state law is REPEALED and a new article 7
2 is added to read as follows:

5 Section 110. Present congressional districts.
6 111. New congressional districts.
7 112. Separability of congressional districts.
8 § 110. Present congressional districts. The congressional districts of
9 this state, as existing immediately before the effective date of this
10 article, shall continue to be the congressional districts of the state
11 until the expiration of the terms of the representatives in congress
12 then in office, except for the purpose of an election of representatives
13 in congress for full terms beginning at such expirations.
14 § 111. New congressional districts. Notwithstanding any other
15 provision of law to the contrary, the congressional districts of this
16 state from and after the effective date of this article, shall consist
17 as follows:

12 § 112. Separability of congressional districts. Each congressional
13 district created by this article shall be deemed a separate district for
14 the purpose of apportionment of the entire state into congressional
15 districts. If one or more congressional districts created by this arti-
16 cle are judicially found not to be in compliance with the decisions and
17 mandates of a court of competent jurisdiction, only the defective
18 district or districts and those immediately adjacent or contiguous ther-
19 eto shall be reapportioned. All other districts shall be deemed to be
20 properly created.
21 § 2. Construction. a. This act shall be liberally construed to effec-
22 tuate the purposes thereof and to apportion and district this state in
23 compliance with constitutional and statutory requirements and shall
24 supersede any inconsistent provision of law including but not limited to
25 section 3 of chapter 17 of the laws of 2012.
26 b. It is intended that this act and the congressional districts
27 described herein completely encompass all the area of the state. It is
28 also intended that such districts apportioned on the basis of 2020 popu-
29 lation, contain the whole number of persons in this state. It is further
30 intended that the apportionment and districting provided for in this act
31 result in the creation of districts containing equal population as near-
32 ly as practicable. It is also intended that no district shall include
33 any of the area included within the description of any other district.
34 § 3. Saving clause. a. If the districts described in the act do not
35 carry out the purposes thereof, because of unintentional omissions;
36 duplications; overlapping areas; erroneous nomenclature; lack of
37 adequate maps or descriptions of political subdivisions, wards, or other
38 divisions thereof, or of their boundary lines; street closings, changes
39 in names of streets, or other changes of public places; alteration of
40 the boundary or courses of waters or waterways, filling in of lands
41 underwater, accretion or other changes in shorelines or alteration of
42 courses, rights of way, or lines of public utilities or other condi-
43 tions, then the state board of elections, at the request of any person
44 or candidate, aggrieved thereby, shall, by order, correct such omis-
45 sions, overlappings, erroneous nomenclature, or other defects in the
46 description of districts so as to accomplish the purposes and objectives
47 of this act.
48 b. In promulgating such orders, the state board of elections, in addi-
49 tion to achieving equality in the population of districts and ensuring
50 that all areas of the state are completely and accurately encompassed in
51 such districts, shall be guided by the following standards:
52 (1) Gaps in the description of any district shall be completed in a
53 manner which results in a total description of that district consonant
54 with the description of adjacent districts and results in complete
55 contiguity of districts.

1 (2) Areas of the state included within the descriptions of more than
2 one district shall be allocated to the district having the lowest popu-
3 lation.
4 (3) Areas of the state not included within the descriptions of any
5 district shall be allocated to the adjacent district having the lowest
6 population.
7 (4) In the event that the area subject to corrected description or
8 allocation as provided in paragraphs one, two or three of this subdivi-
9 sion, is of such size or contains such population that its inclusion as
10 a unit in any district would result in substantial disparity in the
11 size, shape or population of such district, then the state board of
12 elections may allocate portions of such area to two or more districts.
13 (5) In any allocation of area or correction of a description made
14 pursuant to this section, the state board of elections shall, consistent
15 with the foregoing standards, preserve the contiguity and compactness of
16 districts and avoid the unnecessary division of political subdivisions.
17 c. Copies of such orders shall be filed by the state board of
18 elections in its own office and in the office of the affected boards of
19 election. A copy of each such order shall also be filed by the state
20 board with the legislative bill drafting commission to facilitate it in
21 performing its functions under section 70-b of the public officers law.
22 In addition, a copy of such order shall be served upon the person or
23 candidate, if any, who instituted the application for such an order. The
24 state board of elections may adopt reasonable rules regulating the
25 procedure for applications for orders under this section in the manner
26 of serving and filing any notice or copy of orders relating thereto.
27 d. Upon the filing of such an order, the description of any affected
28 district shall be deemed to have been corrected in the manner provided
29 in such order to the full extent as if such correction had been
30 contained in the original description set forth in this act.
31 e. In furtherance of effectuating the provisions of subdivision d of
32 this section, the legislative bill drafting commission, upon receipt
33 from the state board of elections of an order promulgated pursuant to
34 subdivision b of this section, and upon the approval of the temporary
35 president of the senate and the speaker of the assembly, shall cause the
36 description of a congressional district altered pursuant to any such
37 order to be revised accordingly within its data base of the laws of the
38 state of New York so that such altered district may be contained in a
39 publication of the state law and be certified to as a correct transcript
40 of the text of law relating thereto such district in the manner author-
41 ized by section 70-b of the public officers law.
42 f. If any part or provision of this act relating to any congressional
43 district shall be adjudged invalid by a court of competent jurisdiction,
44 such judgment shall: (1) be confined in its operation to the part or
45 provision of this act or the district or districts described herein
46 directly involved in the controversy in which such judgment shall have
47 been rendered, and (2) not affect or impair the validity of the remain-
48 ing parts, provisions or districts described in this act or elsewhere.
49 g. The congressional districts of this state, as existing immediately
50 prior to the effective date of this act, shall continue to be the
51 congressional districts of the state for the purpose of filling vacan-
52 cies in the office of representative in congress at any special election
53 held prior to the general election of the year 2024.
54 h. The congressional districts of this state, from and after the
55 effective date of this act, shall be the congressional districts of the
56 state for the purpose of designating and nominating candidates for

1 representatives in congress, and for electing district delegates and
2 alternate district delegates to national party conventions.
3 i. In order to provide for an orderly election of members of the
4 congress from the state of New York and in recognition of the constitu-
5 tional mandate that congressional districts shall be created by law
6 subject to judicial review under such reasonable regulations as the
7 legislature may prescribe, it is hereby determined and declared that no
8 order of the court invalidating this act or part thereof shall be
9 entered in a manner which will deprive the legislature of an opportunity
10 to discharge its constitutional mandate. In any proceeding for judicial
11 review of the provisions of this act, the determination of the court
12 shall be embodied in a tentative order which shall become final 30 days
13 after service of copies thereof upon the parties unless the court shall,
14 in the interval, on application of any party, resettle its order.
15 j. If any clause, sentence, paragraph, section or part of this act
16 shall be adjudged by any court of competent jurisdiction to be invalid,
17 such judgment shall not affect, impair or invalidate the remainder ther-
18 eof, but shall be confined in its operation to the clause, sentence,
19 paragraph, section or part thereof directly involved in the controversy
20 in which such judgment shall have been rendered.
21 § 4. Separability. If any clause, sentence, paragraph, section or part
22 of this act shall be adjudged by any court of competent jurisdiction to
23 be invalid, such judgment shall not affect, impair or invalidate the
24 remainder thereof, but shall be confined in its operation to the clause,
25 sentence, paragraph, section or part thereof directly involved in the
26 controversy in which such judgment shall have been rendered.
27 § 5. This act shall take effect immediately.
