An act to amend the state law, in relation to establishing congressional
districts; and to repeal article 7 of such law relating thereto
PURPOSE:
The purpose of this bill is to establish 26 congressional districts in
New York State in accordance with a court order decision in the Anthony
S. Hoffmann et al. v. New York State Independent Redistricting Commis-
sion et al.
SUMMARY OF PROVISIONS:
This bill repeals the existing Article 7 of State Law and adds a new
Article 7 establishing new boundaries for New York State's 26 Congres-
sional districts.
Vacancies in congressional districts shall be filled using the bounda-
ries existing prior to this bill's enactment through January 1, 2025, at
which time vacancies shall be filled using the new boundaries estab-
lished by this act.
JUSTIFICATION:
On December 12, 2023, the New York State Court of Appeals ordered that
the New York State Independent Redistricting Commission shall prepare a
redistricting plan to establish new congressional districts and shall
submit to the legislature such plan and the implementing legislation
therefor on or before February 28, 2024.
This bill establishes new congressional districts for New York State.
The districts are based on population figures from the 2020 Federal
Census. All districts comply with the United States and New York State
Constitutions as well as the requirements of the Federal Voting Rights
Act.

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Article 7 of the state law is REPEALED and a new article 7

8 § 110. Present congressional districts. The congressional districts of
9 this state, as existing immediately before the effective date of this
10 article, shall continue to be the congressional districts of the state
11 until the expiration of the terms of the representatives in congress
12 then in office, except for the purpose of an election of representatives
13 in congress for full terms beginning at such expirations.
14 § 111. New congressional districts. Except as provided in section one
15 hundred ten of this article, the congressional districts of this state
16 from and after the effective date of this article, shall consist as
17 follows:

23 § 112. Separability of congressional districts. Each congressional
24 district created by this article shall be deemed a separate district for
25 the purpose of apportionment of the entire state into congressional
26 districts. If one or more congressional districts created by this arti-
27 cle are judicially found not to be in compliance with the decisions and
28 mandates of a court of competent jurisdiction, only the defective
29 district or districts and those immediately adjacent or contiguous ther-
30 eto shall be reapportioned. All other districts shall be deemed to be
31 properly created.
32 § 2. Construction. a. This act shall be liberally construed to effec-
33 tuate the purposes thereof and to apportion and district this state in
34 compliance with constitutional and statutory requirements.
35 b. It is intended that this act and the congressional districts
36 described herein completely encompass all the area of the state. It is
37 also intended that such districts apportioned on the basis of 2020 popu-
38 lation, contain the whole number of persons in this state. It is further
39 intended that the apportionment and districting provided for in this act
40 result in the creation of districts containing equal population as near-
41 ly as practicable. It is also intended that no district shall include
42 any of the area included within the description of any other district.
43 § 3. Saving clause. a. If the districts described in the act do not
44 carry out the purposes thereof, because of unintentional omissions;
45 duplications; overlapping areas; erroneous nomenclature; lack of
46 adequate maps or descriptions of political subdivisions, wards, or other
47 divisions thereof, or of their boundary lines; street closings, changes
48 in names of streets, or other changes of public places; alteration of
49 the boundary or courses of waters or waterways, filling in of lands
50 underwater, accretion or other changes in shorelines or alteration of
51 courses, rights of way, or lines of public utilities or other condi-
52 tions, then the state board of elections, at the request of any person
53 or candidate, aggrieved thereby, shall, by order, correct such omis-
54 sions, overlappings, erroneous nomenclature, or other defects in the
55 description of districts so as to accomplish the purposes and objectives
56 of this act.

1 b. In promulgating such orders, the state board of elections, in addi-
2 tion to achieving equality in the population of districts and ensuring
3 that all areas of the state are completely and accurately encompassed in
4 such districts, shall be guided by the following standards:
5 (1) Gaps in the description of any district shall be completed in a
6 manner which results in a total description of that district consonant
7 with the description of adjacent districts and results in complete
8 contiguity of districts.
9 (2) Areas of the state included within the descriptions of more than
10 one district shall be allocated to the district having the lowest popu-
11 lation.
12 (3) Areas of the state not included within the descriptions of any
13 district shall be allocated to the adjacent district having the lowest
14 population.
15 (4) In the event that the area subject to corrected description or
16 allocation as provided in paragraphs one, two or three of this subdivi-
17 sion, is of such size or contains such population that its inclusion as
18 a unit in any district would result in substantial disparity in the
19 size, shape or population of such district, then the state board of
20 elections may allocate portions of such area to two or more districts.
21 (5) In any allocation of area or correction of a description made
22 pursuant to this section, the state board of elections shall, consistent
23 with the foregoing standards, preserve the contiguity and compactness of
24 districts and avoid the unnecessary division of political subdivisions.
25 c. Copies of such orders shall be filed by the state board of
26 elections in its own office and in the office of the affected boards of
27 election. A copy of each such order shall also be filed by the state
28 board with the legislative bill drafting commission to facilitate it in
29 performing its functions under section 70-b of the public officers law.
30 In addition, a copy of such order shall be served upon the person or
31 candidate, if any, who instituted the application for such an order. The
32 state board of elections may adopt reasonable rules regulating the
33 procedure for applications for orders under this section in the manner
34 of serving and filing any notice or copy of orders relating thereto.
35 d. Upon the filing of such an order, the description of any affected
36 district shall be deemed to have been corrected in the manner provided
37 in such order to the full extent as if such correction had been
38 contained in the original description set forth in this act.
39 e. In furtherance of effectuating the provisions of subdivision d of
40 this section, the legislative bill drafting commission, upon receipt
41 from the state board of elections of an order promulgated pursuant to
42 subdivision b of this section, and upon the approval of the temporary
43 president of the senate and the speaker of the assembly, shall cause the
44 description of a congressional district altered pursuant to any such
45 order to be revised accordingly within its data base of the laws of the
46 state of New York so that such altered district may be contained in a
47 publication of the state law and be certified to as a correct transcript
48 of the text of law relating thereto such district in the manner author-
49 ized by section 70-b of the public officers law.
50 f. If any part or provision of this act relating to any congressional
51 district shall be adjudged invalid by a court of competent jurisdiction,
52 such judgment shall: (1) be confined in its operation to the part or
53 provision of this act or the district or districts described herein
54 directly involved in the controversy in which such judgment shall have
55 been rendered, and (2) not affect or impair the validity of the remain-
56 ing parts, provisions or districts described in this act or elsewhere.

1 g. The congressional districts of this state, as existing immediately
2 prior to the effective date of this act, shall continue to be the
3 congressional districts of the state for the purpose of filling vacan-
4 cies in the office of representative in congress at any special election
5 held prior to the general election of the year 2024.
6 h. The congressional districts of this state, from and after the
7 effective date of this act, shall be the congressional districts of the
8 state for the purpose of designating and nominating candidates for
9 representatives in congress, and for electing district delegates and
10 alternate district delegates to national party conventions.
11 i. In order to provide for an orderly election of members of the
12 congress from the state of New York and in recognition of the constitu-
13 tional mandate that congressional districts shall be created by law
14 subject to judicial review under such reasonable regulations as the
15 legislature may prescribe, it is hereby determined and declared that no
16 order of the court invalidating this act or part thereof shall be
17 entered in a manner which will deprive the legislature of an opportunity
18 to discharge its constitutional mandate. In any proceeding for judicial
19 review of the provisions of this act, the determination of the court
20 shall be embodied in a tentative order which shall become final 30 days
21 after service of copies thereof upon the parties unless the court shall,
22 in the interval, on application of any party, resettle its order.
23 j. If any clause, sentence, paragraph, section or part of this act
24 shall be adjudged by any court of competent jurisdiction to be invalid,
25 such judgment shall not affect, impair or invalidate the remainder ther-
26 eof, but shall be confined in its operation to the clause, sentence,
27 paragraph, section or part thereof directly involved in the controversy
28 in which such judgment shall have been rendered.
29 § 4. Separability. If any clause, sentence, paragraph, section or part
30 of this act shall be adjudged by any court of competent jurisdiction to
31 be invalid, such judgment shall not affect, impair or invalidate the
32 remainder thereof, but shall be confined in its operation to the clause,
33 sentence, paragraph, section or part thereof directly involved in the
34 controversy in which such judgment shall have been rendered.
35 § 5. This act shall take effect immediately.
