  TITLE OF BILL: An act to amend the elder law, in relation to increases in income limit- ing eligibility under the program for elderly pharmaceutical insurance coverage   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to amend provisions of Chapter 800 of the Laws of 2022 relating to eligibility under the Elderly Pharmaceutical Insurance Coverage (EPIC) program.   SUMMARY OF PROVISIONS: Chapter 800 of the Laws of 2022 provided that individuals could not become ineligible for the EPIC program solely due to an increase in their social security benefits or public or private pension. This bill amends Chapter 800 to limit the eligibility extension for one calendar year.   JUSTIFICATION: This bill would ensure effective and equitable implementation of Chapter 800 of the Laws of 2022.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: Undetermined.   EFFECTIVE DATE: This act shall take effect on the same date and in the same manner as a chapter of the laws of 2022 amending the elder law relating to eligibil- ity under the program for elderly pharmaceutical insurance coverage, as proposed in legislative bills numbers S. 3483-A and A. 928-A, takes effect.

        AN ACT to amend the elder law, in relation to increases in income limit-
          ing eligibility under the program for elderly pharmaceutical insurance
          coverage
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Paragraph (i) of subdivision 3 of section 242 of the elder
     2  law, as added by a chapter of the laws of 2022 amending  the  elder  law
     3  relating  to  eligibility  under  the program for elderly pharmaceutical
     4  insurance coverage, as proposed in legislative bills numbers  S.  3483-A
     5  and A. 928-A, is amended to read as follows:
     6    (i)  An  individual  who  is  determined to be eligible for assistance
     7  under this article shall not become ineligible based upon income  solely
     8  because  of  an  increase  in  either  a public or private pension or an
     9  increase in social security benefits as provided under federal law where
    10  such increase does not exceed the consumer price index (all items United
    11  States city average) for such year. This provision shall be  limited  to
    12  one subsequent calendar year.
    13    §  2.  This  act  shall  take  effect on the same date and in the same
    14  manner as a chapter of the laws of 2022 amending the elder law  relating
    15  to  eligibility  under  the program for elderly pharmaceutical insurance
    16  coverage, as proposed in legislative bills  numbers  S.  3483-A  and  A.
    17  928-A, takes effect.
