TITLE OF BILL:
An act to amend the state finance law, in relation to establishing
certain contract requirements involving glazing work
 
PURPOSE OF BILL:
This bill requires that all public works renovation contracts in excess
of one million dollars and all new construction contracts in excess of
five million dollars which require the work of a glazer be performed by
glazers who have a North American Contractor Certification (NACC)
outside of cities with a population of one million or more. It also
phases in requirements by said certified contractors to have architec-
tural glass and metal technicians (AGMT) certified worker employed by
the contractor.
 
SUMMARY OF PROVISIONS:
Section 1, Paragraph 1, § 136-e
Amends the state finance law by creating a new section which requires
that all public works renovation contracts in excess of one million
dollars and all new construction contracts in excess of five million
dollars which require the work of a glazer be performed by glazers who
have a North American Contractor Certification (NACC) outside of cities
with a population of one million or more. It further provides that by
July 1, 2026, said certified contractors have at least one AGMT certi-
fied worker employed by the contractor. It further provides that by.
January 1, 2027, contractors shall have one AGMT certified worker on
each jdb site. It further provides that by January 1, 2028, for each
crew performing work on said jobs, at least 25% of said crew shall by
AGMT certified individuals and by January 1, 2029, that 50% of said crew
shall by AGMT certified.
Section 1, Paragraph 2
Defines glazing work to include but not be limited to: replacement
installation of windows, curtain walls, interior glass partitions, glass
handrails, aluminum entrances, skylights, storefronts, and general
installation of architectural glass and metal.
Section 2, Paragraph 1
Provides that the law will take effect July 1, 2025.
 
JUSTIFICATION:
Contractors that utilize AGMT and NACC certified glazers reduce the
risks associated with selecting glazing installation teams. NACC and
AGMT certification requires a rigorous process including professional
references, proof of insurance, on-site assessment of program compli-
ance, and annual reviews. These high standards ensure that public works
projects are completed by the most capable professional tradesmen possi-
ble and furthers the goal of spending public monies on projects that
will serve as a community investment and have a long project lifespan.

AN ACT to amend the state finance law, in relation to establishing

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The state finance law is amended by adding a new section
2 136-e to read as follows:
3 § 136-e. Contracts involving glazing work. 1. Notwithstanding any
4 other provision of law, all public works renovation contracts that
5 exceed an aggregate amount of one million dollars, and all new
6 construction contracts that exceed an aggregate amount of five million
7 dollars, that include glazing work to be performed outside of a city
8 with a population of one million or more, shall require glazing work
9 performed by North American Contractor Certification ("NACC") certified
10 companies and initially, on and after July first, two thousand twenty-
11 six, shall have one architectural glass and metal technician ("AGMT")
12 certified worker employed by the company or contractor. On and after
13 January first, two thousand twenty-seven, each crew performing work that
14 meets the criteria of this section shall have one AGMT certified worker
15 on site. On and after January first, two thousand twenty-eight, for each
16 crew performing work that meets the criteria of this section, twenty-
17 five percent of that crew shall be comprised of AGMT certified individ-
18 uals on site. On and after January first, two thousand twenty-nine, for
19 each crew performing work that meets the criteria of this section, fifty
20 percent of that crew shall be comprised of AGMT certified individuals on
21 site.
22 2. For the purposes of this section, "glazing work" includes, but is
23 not limited to, replacement and installation of windows, curtain walls,
24 interior glass partitions, glass handrails, aluminum entrances,
25 skylights, store fronts, and general installation of architectural glass
26 and metal.
27 § 2. This act shall take effect July 1, 2025.
