  TITLE OF BILL: An act to amend the correction law, in relation to preventing the over- detention of persons due to an outstanding warrant   PURPOSE OR GENERAL IDEA OF BILL:; The purpose of this bill is to prevent over detention due to outstanding warrants.   SUMMARY OF PROVISION: Section 1: amends the correction law by adding a new section 12 that prohibits the holding of an individual for more than 3 days if they would not be otherwise held if not for an outstanding warrant. Section 2: sets the effective date.   JUSTIFICATION: Despite the constitution making it illegal to,detain inmates for more time than necessary, the criminal justice system has yet to enforce a more just and fair solution to dealing with inmates that are held longer than required. An outstanding warrant from a separate jurisdiction should not be an eligible excuse to hold a person longer than necessary. This bill would simply make it illegal to do so.   PRIOR LEGISLATIVE HISTORY: New Bill.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: TBD.   EFFECTIVE DATE: This act shall take effect one year after it shall have become a law.

        AN ACT to amend the correction law, in relation to preventing the  over-
          detention of persons due to an outstanding warrant
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The correction law is amended by adding a new section 12 to
     2  read as follows:
     3    § 12. Detention on warrant from another jurisdiction. No person  shall
     4  be  held  in a state or local correctional facility within the state for
     5  more than 3 days after when such person would have  been  released  from
     6  such  facility  if not for an outstanding warrant from another jurisdic-
     7  tion unless such state or local correctional facility was informed  that
     8  the warrant is to be acted on by such other jurisdiction.
     9    § 2. This act shall take effect immediately.
