NEW YORK STATE ASSEMBLY MEMORANDUM IN SUPPORT OF LEGISLATION submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A770
SPONSOR: Epstein

TITLE OF BILL:
An act to amend the education law, in relation to requiring school
districts to adopt a policy prohibiting the use of cellular telephones
during classroom instruction

SUMMARY OF PROVISIONS:
Section 1 amends the education law by adding a new section 2801-c
directing the education department to create a model policy that may be
utilized by school districts in their adoption of cell phone bans
Section 2 provides the effective date

JUSTIFICATION:
The proliferation of smartphones has posed major challenges to elementa-
ry and secondary schooling. Learning loss that coincided with the
pandemic has been compounded by distractions posed by smartphones,
particularly social media use. In 2023, the US Surgeon General issued an
advisory about the effects of social media on youth mental health and
included recommendations to pursue policies that limit social media use.
States and schools across the country are increasingly taking action to
limit cell phone use in schools. There is growing consensus among
government officials, pediatricians, mental health professionals, and
educators that cell phone use in schools is detrimental to students'
performance. In some schools that have banned cell phones, administra-
tors are quickly noticing improvements in students' work and classroom
participation.
Recognizing that no one policy may be suitable for all the school
districts throughout the state, this legislation takes a balanced
approach and removes the onus from individual districts to create
original policies limiting cell phone use in schools.
