Joint Statement by Senator Stavisky and Assemblywoman Rozic on Reported Sexual Assault of 12 Year-Old Girl

Queens, NY – Based on a story reported by Madina Toure in Politico and a lawsuit filed by Legal Services of New York City, Senator Toby Stavisky (D-Flushing) and Assemblywoman Nily Rozic (D,WF-Fresh Meadows) became aware of multiple alleged sexual assaults on children at public schools in New York City. One of the alleged incidences took place in a shed near IS 237 in Flushing where a 12 year-old girl was sexually assaulted by a classmate in June of 2018. All students listed in the suit have been issued IEPs, indicating they are children with special needs, prior to being attacked or harassed.

According to the suit, although the incident was reported to school officials, the Department of Education did not take appropriate measures to protect the victims.

Below is a statement from Senator Stavisky and Assemblywoman Rozic, who represent the area in which one of the alleged crimes took place:

“We were beyond shocked when we heard about the assault. We have passed laws that are clear and precise into how these cases are to be handled. The Department of Education is required to provide specific services and follow certain procedures in order to assist victims. If these claims are found to be true, it represents a complete and total failure of the NYC Department of Education to protect our most vulnerable children. The Department of Education must take swift action to ensure all staff understand and comply with laws and regulations established to keep our children safe. When parents or guardians send their children to school, there is a presumption of safety. Schools should be a nurturing environment and that feeling of security has been jeopardized.”
