 TITLE OF BILL :  An act to amend the education law, in relation to
establishing a baccalaureate and associate nursing assistance program

 PURPOSE OR GENERAL IDEA OF BILL:
To address the increasing shortage of nurses in New York State.  The
program assists nursing students in obtaining a baccalaureate and/or
associate degree in nursing by providing loans for students enrolled
in approved institutions.
Nursing students receiving loans through the program will be obligated
for one-year of employment as a nurse in New York State, for each year
of assistance received.
 SUMMARY OF SPECIFIC PROVISIONS:
Establishes a baccalaureate and associate nursing assistance program
within the Department of Education.
The Department shall:
-determine eligibility of applicants
-award the appropriate loans
-establish an Advisory Council to assist in the administration of the
program.
The commissioner shall promulgate rules and regulations as necessary
for the establishment and administration of the program.
 JUSTIFICATION:
New York State is facing a serious shortage of registered nurses; a
shortage that threatens our health care delivery system. The
baccalaureate and associate nursing assistance program provides
incentives for potential nursing students to enroll in, and complete,
a nursing degree program.  By requiring one year of service in New
York State, for each year of assistance received, the program will
increase the number of nurses practicing in the state.
(The program is modeled after the Illinois Baccalaureate Nursing
Assistance Program.)
 PRIOR LEGISLATIVE HISTORY:
2000: no action taken, A7439 of 2002, A3809 of 2004, A6160 of
2005-2006, A4158 of 2007-2008
 FISCAL IMPLICATIONS:  To be determined.
 EFFECTIVE DATE:
This act shall take effect on the first of July next succeeding the
date on which it shall have become a law, provided however, that
effective immediately, the addition, amendment and/or repeal of any
rules or regulations necessary for the implementation of the foregoing
section of this act on its effective date are authorized and directed
to be made and completed on or before such effective date.
