TITLE OF BILL:  An act to amend the general municipal law, in relation
to municipal bidding

PURPOSE OR GENERAL IDEA OF BILL:

To authorize municipalities to utilize contracts for public works
services which have already been let out to bid by the county in which
the political subdivision or district is located, or through any county
within the State.

SUMMARY OF SPECIFIC PROVISIONS:

The bill would amend S 103, subdivision 3, section 1 of the General City
Law by removing article 8 from the exclusions to contracts that an offi-
cer, board or agency of a political subdivision or any district therein
may make purchases upon.

JUSTIFICATION:

This legislation would allow municipalities to bid out contracts (or
piggy-back) on contracts bid out by a County for public works projects.
This legislation would offer municipalities the flexibility to utilize
larger contracts issued by counties, with the potential for reduced cost
savings and time savings for smaller municipalities.

Until recently, municipalities regularly piggy-backed upon public works
contracts initiated by Counties. In 2007 some municipalities were
advised that that this practice was no longer acceptable because of
prohibitions in section 103 of the General Municipal Law. This bill will
remove such prohibition.

PRIOR LEGISLATIVE HISTORY:
None. This is a new bill.

FISCAL IMPLICATIONS:
None to the State. It is anticipated that this measure will result in
savings for municipalities.

EFFECTIVE DATE:
This act shall take effect immediately.
