NEW YORK STATE ASSEMBLY
MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)

BILL NUMBER: A6420

SPONSOR: Stirpe
TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to authorizing private membership establishments to have certain licenses for sale of alcohol   PURPOSE OR GENERAL IDEA OF BILL: To allow for the issuance of liquor licenses to certain private member- ship establishments   SUMMARY OF PROVISIONS: Section 1 amends Section 3 of alcohol beverage control law by adding a new subdivision 39 to define a "private membership establishment." Section 2 amends Section 64 of the alcohol beverage control law so that the new licensees abide by the rules of other on-premises establish- ments. Section 3 amends Section 106 of the alcohol beverage control law to allow the entities to sell beverages "only to its members and to their guests." Section 4 is the effective date.   JUSTIFICATION: This legislation would create a new 'private membership establishment' license within the Alcoholic Beverage Control Law. This change will create a new category for those interested in opening a club in New York and will allow entities that have been authorized under the current club license as not-for-profits the option to modify their licenses. This new category would be subject to the same fee structure as other for-profit entities under Section 64 or 64-a of the ABC Law. This legislation would support the nightlife and hospitality industry, which is an important economic driver for the state.   PRIOR LEGISLATIVE HISTORY: 2023-2024: A.10381/S.9464: Referred to Economic Development / PASSED SENATE   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: TBD   EFFECTIVE DATE: This act shall take effect immediately.
