  TITLE OF BILL: An act to amend the public authorities law, in relation to capital program plans   PURPOSE OR GENERAL IDEA OF BILL: Relates to changing the date of submission of the capital program plan to the capital program review board.   SUMMARY OF PROVISIONS: Amends section 1269-b of the public authorities law to So that each MTA capital program plan is submitted the CPRB a year before it will take effect.   JUSTIFICATION: This bill would move up the date by which the MTA is required to submit its five-year capital plan to the capital program review board (CPRB). Currently, public authorities law requires the authority to submit the plan every fifth year by October first, in preparation for every five- year capital plan. This bill would move up the date to require such submission on or before May 1, 2026, and then January 31 every fifth year there-after. For the MTA's upcoming 2026-2031 capital plan and every following plan, this bill would require the plan to be provided to the CPRB during the legislative session. This shift would allow for a longer period for the public to voice concerns and allow the legislature to have more of a constructive input in the MTA's five-year capital plans.   PRIOR LEGISLATIVE HISTORY: A.11094 of 2017-18; A3383B of 2019-20; A931 of 2021-22; A1316 of 2023-24   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: TBD   EFFECTIVE DATE: Immediate.

        AN ACT to amend the public  authorities  law,  in  relation  to  capital
          program plans
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraphs (b) and (c) of subdivision 1 of  section  1269-b
     2  of  the  public  authorities law, as added by chapter 637 of the laws of
     3  1996, are amended and three new paragraphs (d), (e) and (f) are added to
     4  read as follows:
     5    (b) not later than ten days after the effective date of this paragraph
     6  the authority shall submit to the metropolitan transportation  authority
     7  capital program review board two capital program plans for the five-year
     8  period commencing January first, nineteen hundred ninety-five; [and]
     9    (c) on or before October first, nineteen hundred ninety-nine and every
    10  fifth  year  thereafter,  the authority shall submit to the metropolitan
    11  transportation  authority  capital  program  review  board  two  capital
    12  program  plans  for the five-year period commencing January first of the
    13  following year[.];
    14    (d) on and after January first, two thousand twenty-six, the authority
    15  shall submit to the   metropolitan   transportation authority    capital
    16  program  review  board  on  or before May first, two thousand twenty-six
    17  two  capital program   plans for the five-year period commencing January
    18  first of the following year; and
    19    (e) on and after January first, two thousand thirty-one, the authority
    20  shall  submit  to  the  metropolitan  transportation  authority  capital
    21  program  review  board  on  or before January thirty-first, two thousand
    22  thirty-one and every fifth year thereafter, two  capital  program  plans
    23  for the five-year period commencing January first of the following year.
    24    (f)  Notwithstanding any provision of law to the contrary, the capital
    25  program plans required to be submitted to the  metropolitan  transporta-

     1  tion  authority  capital  program review board by the authority, for all
     2  years other than two thousand  twenty-six,  shall  be  submitted  on  or
     3  before  January  thirty-first  of the year prior to the period for which
     4  the submitted capital program plans take place.
     5    § 2. This act shall take effect immediately.
