TITLE OF BILL:
An act to amend the insurance law, in relation to prohibiting duplicate
coverage relative to long term health care policies
 
PURPOSE OR GENERAL IDEA OF BILL::
This bill would prohibit insurance companies from selling long term care
insurance policies which duplicate existing coverage.
 
SUMMARY OF SPECIFIC PROVISIONS::
Section 1117 of the insurance law is amended by adding a new subsection
(h).
 
JUSTIFICATION::
To avoid duplicate insurance coverage in long term policies that might
be issued by an authorized insurer or an authorized health maintenance
organization. This provision is intended to protect the public from
paying premiums on different policies that contain similar provisions of
coverage.

AN ACT to amend the insurance law, in relation to prohibiting duplicate
coverage relative to long term health care policies
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 1117 of the insurance law is amended by adding a
2 new subsection (m) to read as follows:
3 (m) No policy of insurance covering long term care issued subject to
4 the provisions of this section shall provide any type of coverage to an
5 insured which the insured already has in force and effect at the time of
6 execution of such a policy covering long term care.
7 § 2. This act shall take effect immediately.
