  TITLE OF BILL: An act relating to granting a waiver to Adirondack Helping Hands for the 2016--2017 school year   PURPOSE: The bill ratifies a waiver for $52,000 in spending by Adirondack Helping Hands Inc. in the 201617 school year relating to its 9160 program and prohibits the state from imposing penalties in subsequent years.   SUMMARY OF PROVISIONS: Section 1- Grants a waiver for $52,000 relating to a special class in an integrated setting. The spending shall be offset by $52,000 in recog- nized surplus at the school, and another $16,000 shall be recouped through reconciliation. Section 2 - Directs commissioner of education to calculate and finalize a reconciliation rate, and directs the budget director to approve it. Section 3 - Bars any penalties associated with this waiver in subsequent school years. Section 4 - Effective date   JUSTIFICATION: Through no fault of its own, Adirondack Helping Hands Inc. in Cadyville was required in 201617 to transfer funds between special education programs due to unforeseen changes to its student mix. Adirondack Helping Hands Inc. is a relatively small facility, and contracts with Clinton and Essex counties to provide necessary and important educational services to special needs students. Even a shift of one or two students from one program to another can drastically alter its budget. But the resulting change to the state's calculation for its funding has punished Adirondack Helping Hands Inc. in the years since and reduced its capacity.   LEGISLATIVE HISTORY: 11/17/2021 referred to education 01/05/2022 referred to education   FISCAL IMPLICATIONS: It could result in additional funding for Adirondack Helping Hands Inc.   EFFECTIVE DATE: Effective immediately

        AN ACT relating to granting a waiver to Adirondack Helping Hands for the
          2016--2017 school year
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  (a)  Notwithstanding any provision of law, rule, or regu-
     2  lation to the contrary, Adirondack Helping  Hands  shall  be  granted  a
     3  waiver  in  the  amount  of  $52,000  for  services  rendered during the
     4  2016--2017 school year. Such waiver shall be allocated to costs  associ-
     5  ated  with special class in an integrated setting spending for the 2016-
     6  -2017 school year.  Adirondack Helping Hands shall reduce any recognized
     7  surplus for such school year by $52,000.  A  final  surplus  of  $16,000
     8  shall be recoverable on reconciliation.
     9    (b)  For  purposes  of  this  section, "special class in an integrated
    10  setting" shall mean a classroom where  students  with  intellectual  and
    11  developmental  disabilities  receive special services and supports while
    12  learning alongside students without such disabilities.
    13    § 2. The commissioner of education is hereby directed to calculate and
    14  finalize any rate reconciliation for Adirondack Helping Hands and  shall
    15  submit  such  rate  reconciliation to the director of the budget, who is
    16  hereby directed to approve such submittal.
    17    § 3. No additional penalty associated with such waiver shall be levied
    18  against Adirondack Helping Hands in any subsequent school year.
    19    § 4. This act shall take effect immediately.
