TITLE OF BILL:
An act to amend the public officers law, in relation to the filing of
financial disclosure statements
 
PURPOSE OR GENERAL IDEA OF BILL:
Ensures parity between grade 24 employees of CSEA and PEF as both being
exempt from the requirement to file a Financial Disclosure Statement
(FDS) with the NYS Commission on Ethics and Lobbying in Government.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section 1: Uses the job rate for salary grade (SG) 24 public employees
for CSEA or PEF members, whichever is higher, as the threshold for
filing a Financial Disclosure Statement.
Section 2: Establishes the effective date.
 
DIFFERENCE BETWEEN ORIGINAL AND AMENDED VERSIONS:
Technical amendments.
 
JUSTIFICATION:
Current law uses the CSEA salary grade 24 job rate as the income limit
for being exempt from filing a Financial Disclosure Statement with the
NYS Commission on Ethics and Lobbying in Government. If both CSEA and
PEF members have current contracts, this amount is the same for members
of both unions. However, recently the CSEA contract expired, meaning
that the salary for all their members, including SG 24, did not
increase. At the same time, the PEF contract was in effect and provided
wage increases to its members on April 1, meaning that PEF grade 24
members' salary was temporarily higher than that of their CSEA counter-
parts. This temporarily higher salary triggered the requirement for them
to fill out the disclosure statement.
This legislation would use the higher of the CSEA or PEF SG 24 job rate
salaries as the income limit. This would mean that certain PEF members,
when the CSEA contract. has expired, would no longer have to complete
the form for one year or seek an exemption from filing.

EFFECTIVE DATE:
This act shall take effect on the first of April next succeeding the
date on which it shall have become a law.

AN ACT to amend the public officers law, in relation to the filing of
financial disclosure statements
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (l) of subdivision 1 of section 73-a of the
2 public officers law, as amended by section 5 of part A of chapter 399 of
3 the laws of 2011, is amended to read as follows:
4 (l) The term "filing rate" shall mean the higher of the job [rate]
5 rates of SG-24 as set forth in paragraph a or c of subdivision one of
6 section one hundred thirty of the civil service law as of April first of
7 the year in which an annual financial disclosure statement shall be
8 filed.
9 § 2. This act shall take effect on the first of April next succeeding
10 the date on which it shall have become a law.
